University of Mauritius Mobile Application Terms & Conditions

Please read the following Terms & Conditions ("Agreement") carefully.

Access to the mobile application under the name "University of Mauritius" (the "Application") is not permitted if you do not agree to abide by this Agreement.

This Application is an internal application and has been developed and is being maintained by the University of Mauritius (UoM) (hereinafter referred as "us", "we", or "our").

While using this Application you will have access to materials, documents, images, graphics, logos, design, audio, video and any other information found on this Application (collectively, the "Content").

The following terms and conditions may be updated from time to time at the UoM's sole discretion. Your continued use of the Application is deemed as acceptance of the amended terms and conditions. If you do not agree to the amended terms and conditions, you must cease using the Application.

This Agreement informs you of our terms and conditions regarding the collection and use of Personal Information we receive from users of the Application. We use your Personal Information only for providing and improving the Application.

Your access to and use of the Application is subject to your acceptance of and compliance with these Terms.

Disclaimer

THIS AGREEMENT GOVERNS YOUR ACQUISITION AND USE OF THE APPLICATION. BY CLICKING ON " I accept the Terms & Conditions of the University of Mauritius Mobile Application" , YOU AGREE TO THE TERMS OF THIS AGREEMENT. YOUR ELECTRONIC ACCEPTANCE OF THE AGREEMENT HAS THE SAME EFFECT AS IF YOU HAVE ACTUALLY SIGNED THE AGREEMENT. IF YOU DO NOT AGREE WITH THESE TERMS, YOU MUST NOT ACCEPT THIS AGREEMENT AND SHOULD NOT USE THE APPLICATION.

Registered Users

If you have been granted access to the Application, do not share your login information with others.

It is your responsibility to protect your mobile device from tampering, loss and malwares. Each sign- in is for a single individual only.

As a registered user of the Application, UoM grants you a non-transferable, non-exclusive and revocable access to use the Application according to these Terms and Conditions. Except as expressly granted herein or in any other agreement you have with UoM, you acquire no right, title or license in the Application or any Content or Submission accessed from or incorporated in the Application.

Log Data

Like many Application operators, we collect information that your browser sends whenever you visit our Application ("Log Data"). This Log Data may include information such as pages of our Application that you visit, the time and date of your visit, the time spent on those pages and submitted information.

Termination

Any access granted to you to use this Application is effective until UoM terminates it, or until you stop using the application.

- UoM Students
Current reading students will use the Application until graduation, or upon withdrawal from your Programme of Studies / termination of studies from UoM.

- UoM Staff
UoM staff will use the Application, until termination of contract or retirement.

UoM reserves the right to discontinue providing its service through this Application or block, terminate or suspend your access to the Application and/or the restricted content immediately in its sole discretion, including without limitation if you breach the Terms.

Governing law

These terms and conditions and their subject matter shall be governed by the laws of Mauritius and each party irrevocably submits to the exclusive jurisdiction of the Mauritian court in respect of any dispute arising or in connection with them or their subject matter.

Permitted Uses

Our Application does not allow you to post, link, store, share and otherwise make available certain information, text, media in various format including but not limited to graphics, audios and videos ("Content").

All Content should be consulted online solely for personal, non-commercial use. In respect of the restricted content, you may only search, view, retrieve and display on screen the information.

The content should not otherwise be copied, modified, published, broadcast or otherwise distributed without prior authorization of the UoM.

Intellectual Property Rights

All the content of the Application is the copyright of the UoM or is reproduced with permission from the copyright owner. UoM associated logos and/or other names or logos of products or Applications provided by UoM and referred to on the Application are trademarks of UoM.

All rights not expressly granted to you by these terms are reserved to UoM.

Restrictions on use

This Application has been established and is maintained by UoM. Access to this Application is made available to you by UoM or by an affiliated administrator on behalf of UoM. The distribution of material on this Application may be restricted by the laws and regulations of the country from which you are accessing this Application. Where such restrictions exist, this information is not intended for distribution to, or use by, any person or entity in any such jurisdiction in contravention of those laws and regulations, and persons accessing the Application are required to inform themselves about and to observe any such restrictions.

Personality rights

Any information update and/or modification by the user shall be at their own risk and responsibility. It is also the users’ sole responsibility to ensure that their personal information are accurate.

Third Party Terms

The platform is available on Google Play, governed under the Google Terms of Agreement ("https://play.google.com/intl/en-us_us/about/play-terms/index.html"). The UoM has no control over, and assumes no responsibility for, the content, privacy policies, or practices exhibited by the Google Play.

Security

You must keep the username and password confidential and not disclose that information to anyone else. You must take reasonable steps to keep your password confidential and secure. You agree to notify UoM immediately if you become aware of or have reason to believe that there is any unauthorized use of your password or account or any other breach of security. UoM may also use industry standard methods in order to verify your access rights. However, UoM is in no way liable for any claims or losses related to the use or misuse of your password or account due to the activities of any third party outside of our control or due to your failure to maintain their confidentiality and security.

Application Access

While we endeavour to ensure that the Application is regularly available 24 hours a day, UoM shall have no liability if for any reason our Application is unavailable at any time or period. Access to the Application may be suspended and without any notice in the case of a system failure, natural calamity, maintenance and repair or for reasons beyond our control.

Compliance with Laws

You agree to comply with the relevant applicable laws and regulations that apply to your use of the Applications, Content or any Submission.

Severability

If any provision in these Terms and Conditions is held invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.

Changes

This Agreement is effective as of 10 March 2021 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page. It replaces any prior agreement(s) and is effective between You and UoM.

We reserve the right, at our sole discretion, to modify or replace these Terms or any Applications at any time and you should check this policy periodically. It is Your obligation to ensure that You have read, understood and agree to the most recent terms & conditions available on the Application. Your continued use of the Application after we post any modifications to the policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified policy.
